Court remands Nwoya stepson killer

The Nwoya Chief Magistrate’s Court has today Tuesday, January 10, 2023, remanded a man on charges of causing the death of his stepson in Nwoya District.
Prosecution told court that Morris Opiyo, 23, resident of Latek-odong village in Lungulu sub-county caused the death of Joshua Ogenrwot when he picked him from where he was sleeping and hit him to the ground when his wife, Brenda Ayot, 20, was away tending to her garden on December 27, 2022, at around 8am.
The suspect was arrested on December 28, 2022, at the deceased’s biological father’s home in Ower village, Lungulu sub-county and taken to Nwoya police station on charges of murder under file number PRV/931/2022.
In his recorded statement at the police station, Opiyo admitted to have committed the offence.
An autopsy conducted at Anaka General Hospital indicated that the deceased suffered multiple injuries on the head and sustained a neck and nose fracture that caused his death.
Appearing before the Nwoya chief magistrate, Joe Faye Adoko, Opiyo was not allowed to enter any plea since the chief magistrate’s court does not have the jurisdiction over the case since it is capital in nature.
He was remanded to Nwoya government prison until February 1, 2023, when his case will be mentioned for hearing in a higher court of jurisdiction.
“This court does not have the jurisdiction to handle this case. Therefore, you are further remanded to February 1, 2023, when you will reappear before court for mention of the case,” Ms Adoko said.
The law
Section 188 of Uganda’s Penal Code Act on murder states that “Any person who of malice aforethought causes the death of another person by unlawful act or omission commits murder,” while Section 189 of the same Act on punishment of murder stipulates that “Any person convicted of murder shall be sentenced to death.”
